Monitoring of compliance with legislation requirements

In connection with amendments to the Law of Ukraine "On Personal Data Protection"
From January 1, 2014, the Commissioner for Human Rights (hereinafter referred to as the Commissioner) is responsible for monitoring compliance with the legislation on personal data protection within the powers provided by law.

The control consists in establishing compliance of the process of personal data processing with the requirements of the Constitution of Ukraine, the Law of Ukraine "On Personal Data Protection", the Standard Procedure for Personal Data Processing, and current international agreements of Ukraine in the field of personal data protection.

Control by the Verkhovna Rada Commissioner for Human Rights in the field of personal data protection is carried out by conducting inspections of individuals, individuals - entrepreneurs, enterprises, institutions and organizations of all forms of ownership, public authorities and local governments that own and / or manage personal data . Inspections can be scheduled, unscheduled, on-site and off-site.

The procedure for conducting inspections is established by the Procedure for the Commissioner for Human Rights of the Verkhovna Rada of Ukraine to monitor compliance with the legislation on personal data protection, approved by the order of the Verkhovna Rada of Ukraine Commissioner for Human Rights №1 / 02-14 of January 8, 2014.

Based on the results of inspections, acts of verification of compliance with the requirements of the legislation on personal data protection are drawn up, on the basis of which in case of detection of violations an order on their elimination or a report on administrative offense is drawn up.

Violation of the legislation on personal data protection entails liability established by law. In particular, in case of detection during the inspection provided for in Article 188-39 or Article 188-40 of the Code of Administrative Offenses of Ukraine the subject of inspection in the manner prescribed by law may be fined from one hundred to two thousand non-taxable minimum incomes.

In case of detection of signs of a criminal offense during the inspection, the Commissioner shall send the necessary materials to law enforcement agencies.
