Commissioner: Russian absentee verdict against Crimean Tatar leader Mustafa Dzhemilev - evidence of policy of persecution and repression of Ukrainian citizens

The so-called "Armyansk City Court" controlled by the Russian Federation in the temporarily occupied Crimea handed down sentences in absentia to the leader of the Crimean Tatar people, Mustafa Dzhemilev.

The "court" illegally convicted Mustafa Dzhemilev under Part 3 of Art.  322 of the Criminal Code of the Russian Federation up to two years of imprisonment conditionally for allegedly "illegal crossing" of the administrative border between the Kherson region and the occupied Crimea on May 3, 2014.  Despite the verdict, the "court" released Mustafa Dzhemilev from serving an "amnesty sentence" "in connection with the 70th anniversary of the victory."

Under Part 1 of Article 222 of the Russian Criminal Code (illegal acquisition, transfer, sale, storage, transportation, transfer or carrying of weapons, main parts of firearms, ammunition), the "court" sentenced Mustafa Dzhemilev to 1 year in prison and a fine of 15,000 russian rubles.  from punishment in connection with the expiration of the statute of limitations.

Under Article 224 of the Criminal Code of Russia (negligent possession of firearms), the court fined 20,000 russian rubles and released him from punishment due to the expiration of the statute of limitations.

All the accusations against the citizen of Ukraine are fabricated and have a political basis, and the criminal cases are fabricated.

Today's verdicts are another indication that the occupying country continues its policy of persecution and repression of Ukrainian citizens.

I would like to emphasize that since the beginning of this trial, Mustafv Dzhemilev has been deprived of the right to a fair trial, access to justice and effective legal protection, which is a direct violation of Articles 6 and 13 of the European Convention on Human Rights.

I appeal to the UN Commission for Investigation Human Rights Violations during the Russian Military Invasion of Ukraine to take into account these facts of human rights violations in Ukraine.
