Commissioner: The Verkhovna Rada of Ukraine has adopted laws in the field of human rights protection

Deputies supported in the second reading and in general the Law of Ukraine "On Amendments to Article 161 of the Criminal Code of Ukraine to implement the provisions of the Law of Ukraine" On Preventing and Combating Anti-Semitism in Ukraine "(№5110), which aims to criminalize anti-Semitism.

The results of the monitoring of the Commissioner for Human Rights of the Verkhovna Rada of Ukraine show that when investigating criminal offenses related to discrimination on any grounds, law enforcement agencies do not always take into account probable motives of intolerance, which leads to avoidance of responsibility.

The Ombudsman is convinced that the inclusion of a new criminal offense in Article 161 of the Criminal Code of Ukraine - "manifestations of anti-Semitism" will ensure proper qualification of crimes based on ethnicity and protect the rights of victims to proper pre-trial investigation and punishment of perpetrators.

Parliament passed a law to improve pension legislation (№ 4668). From now on, the legislative level is March 1, the date of the annual indexation of citizens' pensions, in accordance with the Law of Ukraine "On Compulsory State Pension Insurance".

The Commissioner has repeatedly stressed the need to respect the right of citizens to annual indexation of pensions in annual reports on the state of observance and protection of human and civil rights and freedoms in Ukraine.

The Verkhovna Rada of Ukraine adopted the Law of Ukraine “On Amendments to the Law of Ukraine“ On Protection of Public Morality ”Concerning the Protection of the Rights and Best Interests of the Child” (№ 5330-1).

During the analysis of the legislation on the observance of children's rights, the Commissioner identified a shortcoming in regulating the issue of protection of children from the negative impact of sexual or erotic products. Thus, Article 7 of the Law of Ukraine "On Protection of Public Morality" provides for the protection of minors from the negative impact of products of a sexual or erotic nature. This does not take into account the fact that such negative effects can be experienced by children regardless of age, including those under 14 years of age.

At the initiative of the Commissioner, a draft law № 5330-1 was developed and submitted to the Verkhovna Rada of Ukraine, the implementation of which will eliminate existing gaps in legislation and create conditions to protect children from the negative effects of sexual or erotic products.
