Detainees' rights to protection from torture violated: results of repeated monitoring visit to police station № 2 of Shevchenkivskyi UE GUNP in Kyiv

Oleksiy Mylostnyi, an employee of the Department for Implementation of the National Preventive Mechanism of the Secretariat of the Verkhovna Rada of Ukraine Commissioner for Human Rights, and Tetyana Bespalchuk, a public monitor, paid a second monitoring visit to the Shevchenkivskyi Police Department. individuals, including measures to prevent the spread of acute respiratory disease COVID-19 caused by SARS-CoV-2 coronavirus.

During the visit it was found out that the recommendations of the Secretariat of the Commissioner for Human Rights of Ukraine provided after the visit to the Police Department on February 23, 2021, the Shevchenkivskyi Police Department and the Police Department did not organize work to eliminate the identified shortcomings. No recommendations made since the last visit have been implemented.

The police department violates the rights of detainees to protection from torture or inhuman or degrading treatment or punishment. In particular, the available room for detainees for 3 people is not used, detainees were under the control of police officers for a long time and were kept in the police station, but they were not provided with food, drinking water and free access to toilets.

The police department has not appointed an official responsible for the detention of detainees, therefore the requirements of the Criminal Procedure Code of Ukraine to ensure that all actions taken with the detainee are recorded in the relevant journals are not met.

The monitoring team found that the police department did not take sufficient measures to prevent the spread of acute respiratory disease COVID-19 caused by the SARS-CoV-2 coronavirus. In particular, at the entrance to the police station there is no temperature screening of visitors and delivered persons. There is no capacity to collect used personal protective equipment.

A report on the results of the monitoring visit with relevant recommendations will be sent to the relevant authorities to address the identified shortcomings.
