Monitoring the observance of the right of citizens to apply to the subjects of power through the personal reception of their leaders by the Ministry of Internal Affairs of Ukraine in the conditions of quarantine restrictions

Oleksandr Donkoglov, Deputy Head of the Department - Head of the Department for Observance of the Right to Appeal of the Office for Monitoring the Rights to Appeals and Information of the Secretariat of the Verkhovna Rada of Ukraine Commissioner for Human Rights, paid a monitoring visit to the Ministry of Internal Affairs of Ukraine.

During the monitoring, the Ministry of Internal Affairs of Ukraine checked the observance of the right of citizens to apply to the subjects of power through personal reception by their leaders in the conditions of quarantine restrictions.

During the inspection it was established that the personal reception of citizens in the Ministry was suspended indefinitely due to the prevention of the spread of acute respiratory disease COVID-19 caused by coronavirus SARS-CoV-2 in Ukraine, as evidenced by the announcement for citizens posted on the entrance door to the public reception. The entrance to the public reception was closed during the monitoring visit. At the same time, citizens are invited to process appeals in accordance with the requirements of Article 5 of the Law of Ukraine "On Citizens' Appeals" and submit them through a box located in the central entrance of the Ministry or to a designated e-mail address.

There is no schedule and procedure for holding a personal reception of citizens on the information stand and on the official website of the Ministry in the premises of the public reception. Instead, the printed text of the Law of Ukraine "On Citizens' Appeals" and schedules of personal reception of citizens by the leadership of the Ministry and the National Police of Ukraine, approved in 2019, are available on this stand.

As the employees of the public reception of the Ministry explained, the new schedule of personal reception of citizens has been developed and is being approved by the Minister. With regard to the procedure for personal reception of citizens in the reception of the Ministry, this procedure was approved by the order of the Ministry № 500 of 24.06.2005, but not published on the website, as the official website is in test mode.

Personal reception of citizens is recorded in the electronic document management system of the Ministry of Internal Affairs, but due to the termination of personal reception of citizens due to the spread of acute respiratory disease COVID-19 in Ukraine since the beginning of 2022 no personal reception was held.

Based on the results of the monitoring, the staff of the public reception of the Ministry was provided with methodological recommendations on the inadmissibility of restricting the right to appeal guaranteed by Article 40 of the Constitution of Ukraine and the derived right to personal reception by heads of quarantine restrictions. In particular, the persons responsible for holding a personal reception at the Ministry are recommended to renew it if the applicants have one of the following documents: COVID-certificate of recovery; international, domestic certificate or foreign certificate confirming vaccination against COVID-19; negative result of testing for COVID-19 by PCR or rapid test for the antigen of coronavirus SARS-CoV-2, which is valid for 72 hours. This right can also be exercised by the Ministry by videoconference using its own technical means.
